Scope of Services
Web Artistry provides digital marketing services to clients, including social media marketing and website design and development. We will use our professional skills and expertise to create a digital presence that meets the specific needs and requirements of the client.
Client Responsibilities
The client is responsible for providing all content for the digital marketing materials, including text, images, and other media. The client is also responsible for reviewing and approving the website design and layout, as well as the social media marketing plan, before the final product is delivered.
Payment
The client must make a one-time payment or the first payment of a monthly retainer before work on the digital marketing materials can commence. If opting for the monthly retainer, subsequent payments are due on the first of each month following the initial payment.
Cancellation and Refund Policy
If the client decides to cancel the project after work has begun, any deposit paid will not be refunded. If the client is not satisfied with the final product, they may request revisions. If the client is still not satisfied after the revisions have been made, Web Artistry will issue a partial refund based on the percentage of work completed. Cancelling a monthly retainer will be effective in the next calendar month, and all services will stop
Warranty
Web Artistry warrants that the digital marketing materials will be free from defects in material and workmanship for a period of 30 days from the date of delivery. If the client discovers any defects during this period, Web Artistry will correct the defects at no additional cost to the client.
Limitation of Liability
Web Artistry shall not be liable for any damages, including but not limited to, direct, indirect, special, incidental, or consequential damages, arising out of or in connection with the use of the digital marketing materials or the inability to use them.
Indemnification
The client agrees to indemnify and hold Web Artistry and its employees and agents harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of the client's use of the digital marketing materials or the violation of these terms and conditions.
Governing Law
These terms and conditions shall be governed by and construed in accordance with the laws of England and Wales, without giving effect to any principles of conflicts of law.
Dispute Resolution
Any dispute arising out of or in connection with these terms and conditions shall be resolved through negotiation between the parties. If the parties are unable to resolve the dispute through negotiation, they agree to submit the dispute to mediation in accordance with the rules of the Chartered Institute of Arbitrators.
No Lawsuit
The client agrees that they will not file a lawsuit against Web Artistry for any reason arising out of or in connection with these terms and conditions or the use of the digital marketing materials.
Severability
If any provision of these terms and conditions is found to be invalid or unenforceable, that provision shall be enforced to the maximum extent possible, and the remaining provisions shall remain in full force and effect.Entire AgreementThese terms and conditions constitute the entire agreement between the parties and supersede all prior and contemporaneous understandings or agreements, whether oral or written.
Changes to These Terms and Conditions
Web Artistry reserves the right to update or modify these terms and conditions at any time without prior notice. Any changes will be effective immediately upon posting on our website. The client is responsible for regularly reviewing these terms and conditions to stay informed of any updates or modifications. Continued use of our services after any updates or modifications are posted will constitute acceptance of the updated terms and conditions.
